INTERSECTING PERSPECTIVES ON DOMESTIC VIOLENCE: POSITIVE LAW, FEMINIST THEORY, AND ISLAMIC LAW

Domestic violence (DV) represents a complex form of crime, encompassing legal, social, and cultural dimensions. This article examines the issue of DV through an interdisciplinary lens, combining the perspectives of Indonesian positive criminal law, feminist criminology theory, and Islamic criminal law. The core problem lies in the unequal legal protection afforded to DV victims, particularly women, due to the predominance of formalistic and gender-biased legal interpretations. This study aims to critically assess how each of these frameworks conceptualizes and addresses DV, and to identify points of convergence that can serve as the foundation for more equitable policy formulation. Employing a normative juridical method, the study utilizes a conceptual approach and case studies, including an analysis of court decisions. The findings reveal that positive law still faces serious challenges in implementation, while feminist criminology and Islamic law offer more contextual and ethically grounded paradigms of protection. The article recommends a DV mitigation strategy based on legal integration, gender equality, and substantive justice. These findings are significant for developing legal policies that are more responsive to the lived realities of victims.
